Video game publisher, developer and distributor Take-Two Interactive is currently embroiled in a time and attendance lawsuit after a former employee sued the company over its employee attendance policies.
Aaron Martinez alleges that while working for Take-Two as a quality assurance tester at its California-based Visual Concepts studio, the company violated the Fair Labor Standards Act in several ways. Specifically, it reportedly failed to provide meal and rest breaks, did not pay him for all of the hours he worked, failed to observe the state's minimum wage laws and neglected to compensate him at an overtime rate that had been previously agreed upon. Additionally, Take-Two's record-keeping practices were called into question.
Martinez is seeking a class action lawsuit that could include as many as 400 employees, according to Develop Online. In order for a class action suit to go ahead, the group of plaintiffs must provide evidence that they were wronged under a similar set of circumstances, with the lead plaintiff - in this case, Martinez - representing them.
