Managers and assistant managers employed under the parent company CST Brands Inc., have successfully filed for collective action certification in a lawsuit charging the enterprise with violations of time and attendance policies, according to Convenience Store News.
The law firm Sanford Heisler informed more than 3,400 employees of Valero Energy Corporation and CST Brands' Corner Store locations they are able to join in the case. Cindy Hill, general counsel for CST Brands, stated the company has consistently employed a policy that complies with federal and state regulations. The lawsuit alleges managers were never fairly compensated for duties performed before and after their regularly scheduled shifts, resulting in an accumulation of unpaid overtime wages, San Antonio Business Journal reported.
Janette Wipper, lead counsel for the managers, explained Corner Store manager and assistant managers were required to perform tasks off-site, such as conducting surveys of competitors' gas prices and watching employees to maintain quality assurance. However, these kinds of work were difficult to track using the existing time clock systems the company had in place. Employees were instructed to perform a variety of duties without punching in to avoid negatively influencing the company's budget.
