The Southern Utah Pecan Ranch was recently called into question for suspected child labor rights violations, but an investigation by the Department of Labor only found a supervisor who was willing to take responsibility for time and attendance practices. In December 2012, pictures of young children working during a pecan harvest prompted questions about Fair Labor Standards Act compliance.
When DOL investigators visited the site, they made an agreement with the employer to ensure that all future work would be in full compliance with the FLSA.
"We are pleased that this grower has agreed to take responsibility to make sure the contractors it hires to harvest pecans on its ranch operate in compliance with federal labor laws," said Cynthia Watson, regional administrator for the Southwest division of the WHD. "Vulnerable agricultural employees, particularly minors, too often are exploited for a wide variety of reasons."
If employers are working to demonstrate their compliance, they can use a thorough payroll processing system that tracks employees' time and attendance and total hours worked. These documents can be presented should any questions about compliance ever rise.
