A National Conference of Synagogue Youth chapter adviser recently filed a class action lawsuit against the Orthodox Union, alleging her employer violated federal time and attendance regulations, according to the Jewish Telegraphic Agency.
Devorah Lunger claims she was not paid for overtime employee attendance. Additionally, she says she was not provided with the rest breaks and meal breaks, and also accuses the OU of failing to provide itemized wage statements, a violation of Fair Labor Standards Act record-keeping provisions.
Lunger's lawyer, Arnold Pedowitz, notes that in addition to the FLSA infractions, the organization is also falling short on its religious obligations.
"In terms of the legal merits, it is a straightforward Fair Labor Standards Act case, a failure to pay overtime," Pedowitz said, as quoted by the news source. "But this is a case involving a very religious organization. They should be operating at the highest standards, and our client is upset that they are not."
Ari Hart, the founder of Orthodox social justice group Uri L'Tzedek, spoke out about FLSA violations in connection with kosher cheese company Flaum earlier this year, according to a separate article by the news source.
"Exploiting immigrant labor is not (ethical) according to Jewish and secular law," he said.
