Three New York restaurants to pay employees over $1 million in back wages

Three full-service New York restaurants in Nassau and Westchester counties were recently investigated and found in violation of the Fair Labor Standards Act (FLSA) minimum wage, overtime and recordkeeping provisions, according to the Department of Labor's Wage and Hour Division.  As a result, Asian Moon Restaurant in Massapequa Park, Golden Rod Restaurant in New Rochelle and Asian Moon Restaurant in Garden City have been ordered to pay 255 employees a total of $1.08 million in back wages for their unpaid time and attendance as well as liquidated damages with interest.

"These workers suffered egregious labor violations," said Secretary of Labor Hilda Solis. "The Department of Labor is committed to using all tools available to recover workers' wages and ensure accountability under the law."

Solis adds that investigations are one of the tools the DOL uses to ensure employees are receiving the wages they have rightfully earned. The employers in question were suspected of not maintaining proper records for workers and paying kitchen staff members at a rate less than federal minimum wage - $7.25 per hour.

Restaurants are one of the industries that frequently faces conflict with the FLSA. Employers may find it difficult to calculate employees' wages correctly because staff members fill multiple roles that fall under varying pay requirements. An advanced timekeeping system can help managers maintain better records and bring their payroll into compliance.
