A salon worker in Sherman, Texas, has filed a lawsuit against her former employer, alleging the establishment violated overtime laws. Virginia Cooks has brought forth a collective lawsuit representing herself and a group of other current and former employees who claim they were not appropriately paid for their time and attendance while working at the salon.
According to The Southeast Texas Record, the plaintiffs seeking damages are all workers who are or were employed at Ulta Salon Cosmetics & Fragrance Inc. from 2010 onward. The salon is being charged with allegations that it violated the Fair Labor Standards Act by denying rightful overtime payments for work in excess of 40 hours per week, as well as for violations against minimum wage mandates.
In addition to the overtime issues, Cook claims that soon after she began her employment at the salon, she noticed several safety issues on the premises, including broken chairs, mats with raised edges and defective tools. Cook says her complaints were ignored, and when she sustained an injury due to the state of the workplace, she was fired the next month.
Among other requests, Cook and the other plaintiffs are seeking back pay for overtime wages, mental anguish, lost employment benefits and punitive payments.
