A recreational vehicle dealership in East Texas is being sued for allegedly violating the Fair Labor Standards Act's time and attendance provisions, according to the Southeast Texas Record.
Two of the company's service department employees, Wesley Pittman and Shaun Pittman, filed suit against McClain's R.V. and its owners on behalf of themselves and other current or former workers employed by the defendants since January 2009.
The plaintiffs allege they were not adequately compensated for the
employee attendance they put in at a regular rate of pay, nor did they receive time-and-a-half for working more than 40 hours in one work week. The company is accused of estimating how long employees would to take to complete a job and compensating them for only that amount, regardless of the length of time the work actually took.
Additionally, McClain's R.V. and its owners are accused of altering workers'
timeclock records and retaliating against those that complained about their practices.
Elsewhere in Texas, six public works employees from the city of Plano recently had a settlement approved for a similar overtime lawsuit, according to the Louisville Leader.
