Fort Scott, Kansas-based contractor Mid-Continental Restoration was recently ordered to pay more than $99,000 in employee attendance back pay to 47 workers at its Murfreesboro, Tennessee, location.
The company - which specializes in masonry and concrete restoration - was investigated for Fair Labor Standards Act violations by the U.S. Department of Labor's Wage and Hour Division. Investigators found that it violated federal time and attendance legislation related to minimum wage and overtime by not compensating workers for travel time. Additionally, the company did not include discretionary bonuses in its employee overtime rate calculations.
According to The Tennessean, the company agreed to update its policies and employee tracking practices to ensure all hours worked are accurately recorded and compensated.
Overtime was also at issue in the state's jail system recently, following an August inspection of the Tennessee Corrections Institute that revealed insufficient security protocols, The Daily News Journal reports. According to Rutherford County sheriff Robert Arnold, the safety issues were caused by understaffing and the only way to mitigate this would be to dip into the county's overtime budget.
