Three car washes, all owned by the same employer, have been ordered to pay employees proper wages after the Department of Labor found the organization wasn't fairly paying workers. While staff members were at the establishment for 40 hours a week, they were forced to clock out when cars weren't at the facility to be washed. This resulted in them only being paid for approximately 25 to 30 hours per week.
The DOL is cracking down on the owner of the establishments and is ordering workers to be paid more than $300,000 for their time and attendance that was not previously compensated for. The Arizona Daily Star also mentioned that the workers who were forced to go off the clock were not allowed to leave the car wash. The owner would not necessarily have violated these particular FLSA rules if the workers had been allowed to go home during their breaks. However, this was not the case as they had to stay at the facilities while the employer controlled their time.
Additionally, the car wash owner reportedly had underage workers completing more than 8 hours of work a day at the establishments. This is in violation of federal laws and the owner may face more charges and fines.
