Dustin Sigmon, an air conditioner repairman, recently filed a lawsuit against his former employer, claiming the company violated federal labor laws. Sigmon filed the suit on Aug. 7 in Sherman, Texas, in an effort to win financial rewards from the company through a court case.
According to The Southeast Texas Record, the plaintiff worked as an air conditioner repairman at Air Doctor Inc., an air conditioning and furnace repair company, from May 2006 to August 2011. Sigmon charges that, during that five year period, he often worked more than 40 hours per week, but was routinely denied overtime payments for his excess time and attendance. Under federal laws, workers must be paid time-and-a-half when working overtime.
If the allegations are found to be true, Air Doctor will have violated the Federal Labor Standards Act by denying a worker overtime payments. While many wage disputes are settled out of court or before a judge, the plaintiff has requested a trial by jury.
Sigmon is seeking financial damages through the trial, including interest on the overtime payments accrued over the past several years, as well as for court and attorney costs.
