A preliminary agreement has been reached in the RBS Citizens Financial Inc. employee time and payment case. It was announced on June 10 that the plaintiffs and RBS have reached an arrangement to transfer the cases regarding the overtime payment disputes that were filed in federal courts in Illinois, Massachusetts, New York and Pennsylvania.
The plaintiffs alleged that the bank violated the Fair Labor Standards Act by misclassifying assistant branch managers to avoid overtime payments. According to the plaintiffs, assistant branch managers across the company were filed as exempt workers, freeing RBS from paying them overtime fees. Current and former workers are now seeking damages, including back pay, as part of a class action lawsuit against the company.
The employees are being represented by Brendan Donelon and Peter Winebrake. Donelon told Reuters that he expects the case to reach a positive conclusion.
"The parties have reached a resolution that is to everyone's satisfaction," Donelon stated.
Although the specifics of the settlement have not been revealed, both parties have determined that a "global settlement agreement" has been reached, which has determined that each of the separate cases are to be transferred to a federal court in Brooklyn where a decision will be reached.
