A former oilfield services company technician has filed suit against his ex-employer, claiming he was fired for complaining about time and attendance violations, the Southeast Texas Record reports.
After Technical Specialty Products updated its company policy in September, Dale Little stopped being compensated for the time it took him to travel to and from work sites. Little claims that although he worked an average of 55 hours per week, he was not adequately paid for his overtime employee attendance. Regulations set by the Fair Labor Standards Act require employees to be paid time-and-a-half for each hour worked that exceeds 40 hours in one week.
Little was terminated last month after raising the issue with the company. As part of the wrongful termination case, he is seeking damages for unpaid overtime compensation and lost wages, as well as legal fees, interest and punitive damages, the news source reports.
Earlier this month, the Texoma, Texas, Council of Governments was accused of trying to avoid overtime in a different way - by intentionally misclassifying a worker, according to a separate article by the news source. The employee is suing for back wages.
