New Jersey prison officers sue for overtime compensation

Prison officers in an Atlantic County, N.J. correctional facility claim they were not compensated for their time and attendance past normal working hours. They are suing for overtime back pay, claiming the Atlantic County Department of Law repeatedly violated the Fair Labor Standards Act and is withholding wages the officers are owed, according to Corrections One news source.

Attorney Andrew Glenn is representing George Herbert and Jeffrey Creighton in the lawsuit, along with 78 other officers who have decided to join the class-action suit. Glenn said the workers are being forced to stay anywhere from 10 or 20 minutes to an hour longer than their actual shifts, without getting paid any overtime. Managers who should be supervising employee time and attendance are "turning a blind eye" when they should be adhering to FLSA standards.

Employee tracking is an important part of running a business smoothly and complying with wage and labor regulations. The 80 plaintiffs are suing for compensation for additional time worked outside of shifts, liquidated damages, attorneys' fees and other miscellaneous costs.

The 80 employees are waiting to see if the suit is certified. If it is, more than 200 other workers may choose to join to make sure they receive proper wages for overtime.
