Following an investigation by the Missouri Labor Department's Division of Labor Standards, Franklin County-based Spray Services recently agreed to reimburse workers for more than $24,000 in unpaid overtime.
Spray Services - a general contractor hired to conduct lead abatement procedures for a public school in St. Louis - was required under state law as well as the Fair Labor Standards Act to pay its employees time-and-a-half for hours worked in excess of 40 per week. However, the investigation revealed that this legislation had not been upheld in the cases of 10 of its workers.
"The prevailing wage law ensures that the work on public projects maintains the local wage and tax base," explained department director Larry Rebman.
The company's time and attendance violations were brought to the attention of the department by one of its competitors which had previously been cited for the same infraction and did not want Spray Services to be exempt from the rules.
According to the St. Louis Business Journal, the company's owner claimed to be following union wages determined by unions' local bargaining agreements, which were defined differently than those set by the state.
