Local pizza shop fails to deliver fair pay

Cecil Whittaker's Pizzeria may be a St. Louis mainstay, but the results of a recent Department of Labor investigation suggest it wasn't a great place for community members to get a job driving delivery orders.

Most customer service jobs are straight-forward, an employee receives minimum wage (at least) and tips on top of that, if they're lucky enough to score a position at a restaurant or food service company. Delivery drivers at Cecil Whittaker's Pizzeria, however, were not that lucky.

The recent investigation suggests 58 drivers were classified as "independent contractors" rather than employees, and that instead of receiving the federal base pay for time and attendance, they were issued just $3 per delivery. Even when this was totaled up, it did not come to $7.25 per hour, the DOL reports.

"Far too often, employers misclassify their employees as independent contractors to avoid paying them in compliance with the FLSA, as well as other federal, state and local laws," said Norma Cervi, St. Louis' Wage and Hour Division (WHD) district director. "The WHD is vigorously pursuing corrective action in those situations when workers are employees, to ensure that they are paid required wages."

To make up for this misclassification, owners Donna and Donald Glenn have facilitated training across locations and given employees materials outlining their labor rights.
