A loan processor for East Texas-based Bank of the West and GSB Mortgage recently filed a class action lawsuit against the company for inaccurately calculating her overtime employee attendance rate, according to the Southeast Texas Record.
Susan Dooling, the lead plaintiff, was classified as a non-exempt hourly employee by the financial institution. However, in determining overtime, the bank failed to include commissions and non-discretionary bonuses. This practice is a violation of the Fair Labor Standards Act and resulted in them receiving less compensation than they should have.
Elsewhere in Texas, two former employees of Corpus Christi-based Refinery Terminal Fire recently filed a time and attendance lawsuit against the group, claiming that they had been wrongfully classified as exempt from FLSA wage and overtime regulations, according to the Corpus Christi Caller Times.
According to the plaintiffs' attorney, both men - senior level captain Joe Dale Martinez and firefighter Fidencio Lopez, Jr. - are eligible for overtime pay due to FLSA first responder provisions.
