Three Los Angeles carwash business were recently taken to court by the California Labor Commissioner for payroll procedures that were in violation of the Fair Labor Standards Act (FSLA). The California Department of Industrial Relations' (DIR) Division of Labor Standards Enforcement investigated Rosecrans King Car Wash, Wilshire Car Wash and Vermont Auto Spa.
The California Labor Commissioner Jule A. Su found all three carwash companies in violation of FLSA minimum wage and overtime measures. Employees of the businesses are seeking more than $2 million to recoup unpaid wages, penalties and damages.
"Our investigations found that employers knowingly and willfully failed to properly record accurate time records for each worker and failed to provide them with itemized wage deduction statements with their pay," said Su.
The businesses did not provide workers with records of their
employee attendance, so the workers had no idea if they were being paid properly for their time. Evidence from the investigation into Rosecrans King Car Wash revealed the employers were in fact not paying workers for all of their hours worked. To prevent violations in the future, businesses such as these can update payroll monitoring with a timclock that can accurately record employees' work time.
