KPMG faces time and attendance lawsuit

Professional services firm KPMG was recently sued for the misclassification of thousands of entry-level audit workers, denying them proper overtime wages. 

According to the lawsuit, the New York-based firm mistakenly exempted the workers from overtime provisions set by the Fair Labor Standards Act (FLSA) and the New York Labor Law.

A federal court in the state conditionally certified a national collective action lawsuit against the company. So far, KPMG workers from Florida, Nebraska, New Jersey, New York, Texas and Washington have joined the employee attendance case, according to law firm Outten & Golden, which is representing the plaintiffs.

"We are pleased that the Court has allowed us to inform KPMG audit associates nationwide of their right to join this lawsuit and attempt to recover the overtime wages they earned but were not paid," said Outten & Golden's Justin Swartz in a statement.

Last month, a similar lawsuit was filed against Apple. The company's virtual at-home call center employees alleged that it deliberately misclassified them as independent contractors to avoid paying overtime.
