A former kindergarten teacher at a childcare facility in Sherman, Texas, recently filed a lawsuit against the company alleging that she was fired for complaining about not being awarded the correct overtime compensation, according to the Southeast Texas Record.
Laura Beytia claims to have often worked more than 40 hours a week at Allen Creme de la Creme, in addition to being required to attend mandatory meetings and other assorted after-hours events. Despite her non-exempt status, she was not paid overtime, even after complaining to the facility's executive director. Consequently, she contacted the facility's corporate office, and was fired soon afterwards, the newspaper reports.
Although Beytia's employment was officially terminated due to her mistakenly providing milk to a child with a milk allergy, she claims that this was a convenient excuse for the facility to let her go. She is currently suing the defendant for Fair Labor Standards Act violation and wrongful termination, and is seeking damages for lost wages.
Compensation must be provided for employee attendance at events such as meetings that occur outside of regular work hours, and should be paid time-and-a-half for hours worked beyond 40 per week, according to the FLSA.
