Indianapolis hotel workers recently filed a time and attendance lawsuit against 10 major hotel chains and human resources company Hospitality Staffing Solutions (HSS) over alleged wage and hour violations, according to a statement by local union Unite Here Indy.
The plaintiffs claim their paychecks did not reflect all hours of
employee attendance. They allege that they were forced to work off the clock and were not afforded the meal and rest breaks mandated by the Fair Labor Standards Act.
Nearly every hotel in the downtown Indianapolis area was named in the suit, including the Hyatt Regency, Holiday Inn Airport and the Omni Hotel.
"Every day I was told by my Hyatt manager to come in to work early and work before clocking in, and forced to work through my breaks without being paid," said suit member Martha Gonzalez, a former Hyatt hotel housekeeper subcontracted through the HSS agency.
Eligible employees could be entitled to as much as $10 million in back pay if the suit is certified as a collective action. According to WRTV, workers are considering a strike over the Super Bowl weekend.
