An employee of Montrose Memorial Hospital in Colorado has filed a lawsuit in attempt to recollect wages he is allegedly owed for overtime employee attendance, according to The Montrose Daily Press. Jeffrey D. Brewer claims he was classified as an exempt employee when he was working as a network administrator and that because of this position, he was not paid any more for working longer than 40 hours.
The Fair Labor Standards Act (FLSA) requires employers to pay all non-exempt employees one-and-a-half times their standard hourly rate when they work more than 40 hours during a single workweek. Exemptions apply to workers in certain positions, such as those performing administrative, executive or professional work. Moreover, Brewer alleges the hospital was in the practice of changing employees' classifications as a strategy to avoid paying overtime, the source adds.
The Department of Labor makes a point to investigate and punish employers who are deliberately violating the FLSA and attempting to pay employees less than they have rightfully earned.
