Healthcare worker sues over alleged time and attendance violations

A Mesquite, Texas, healthcare worker recently sued her employer over alleged violations of time and attendance laws, according to the Southeast Texas Record.

Debra Buxton filed the class action lawsuit against Tinsley Associates, which does business as Exceptional Home Care. The plaintiff claims the company did not compensate healthcare workers at a time-and-a-half rate for employee attendance that exceeded 40 hours in one week, a contravention of Fair Labor Standards Act provisions.

Buxton said she lodged a complaint with Tinsley Associates, but the company is yet to take any steps toward correcting the violation. She also alleges that her termination on October 31 was motivated by retaliation and is suing for unpaid wages, liquidated damages, attorneys' fees and court costs.

In a similar lawsuit filed in the state earlier this month, a former dry cleaning employee claimed he was unfairly terminated after complaining about inadequate overtime compensation. David Greer was fired by Image Drycleaners and Laundry in August after nearly two years of employment with the company, according to a separate article by the news source.
