A Texas dry cleaning company was recently sued by a former employee for alleged overtime violations, according to the Southeast Texas Record.
David Greer filed suit against Image Drycleaners and Laundry in the Eastern District of Texas, Sherman Division earlier this month, claiming he was improperly classified as exempt from the overtime provisions of the Fair Labor Standards Act.
Greer claims he put in approximately 15 hours of overtime
employee attendance per week while employed by the company between November 2009 and August of this year. He alleges that Image terminated him after he went to the company's president to report his belief that he was being inadequately compensated.
The plaintiff is suing for unpaid overtime compensation, back pay and front pay, lost benefits, liquidated damages, court costs, attorney's fees and interest. Additionally, he is petitioning for reinstatement to his previous position and pay grade.
A similar case in Alabama garnered an award of more than $822,000 in front pay for a plaintiff, the Decatur Daily reports. Baronica Warren was fired after she took legal action over a salary reduction and unfair time and attendance practices. According to her lawyer, Gregg Smith, she was not permitted to put in overtime employee attendance despite the fact that a coworker routinely logged 20 extra hours per week.
