Fashion designer Alexander Wang has been charged with a $50 million lawsuit claiming Fair Labor Standards Act (FLSA) violations for failing to pay workers overtime.
Thirty workers filed the suit against Wang for forcing them to work 16-hour days without overtime pay. They also allege the facility they worked in was cramped with no windows - conditions similar to a sweatshop.
So far, Wendy Lu and Flor Duante have come forward with allegations that their employer required them to work long hours without proper compensation. Moreover, they both attest they were fired after making workers compensation claims.
"The company takes its obligations to comply with the law very seriously, including the relevant wage and hour regulations, the payment of overtime to eligible employees and having a safe working environment for all of our employees. We will vehemently defend any allegations to the contrary,” said Wang.
In order to defend his company against the claims, Wang will need to produce accurate payroll records that meet FLSA standards. The Department of Labor's Wage and Hour division may also request proof of
employee attendance from a reliable source, such as an electronic
timeclock that keeps track of workers' punches in and out of work.
