El Paso daycare agrees to pay $23,000 in back wage for unpaid time and attendance

Ice Castles Too Learning Center and Child Care in El Paso, Texas, has agreed to pay 92 employees a total of $23,391 in back wages. The child care facility has been under investigation by the Department of Labor since 2009, according to KFOX-TV. This year, the Wage and Hour Division requested workers' I-9 forms to verify employment eligibility.

Investigators discovered Ice Castles Too employees were victims of wage theft, as their employers were illegally deducting uniform costs from employee attendance wages and were not properly compensating them for training time. The Fair Labor Standards Act (FLSA) guarantees workers receive at least minimum wage - $7.25 - for all of their hours worked. If employees are required to buy uniforms for the job, employers must make sure the costs do not drop earnings below that rate.

"These employees did not receive legally required wages for all hours worked," said Cynthia Watson, regional administrator for the Southwest Wage and Hour Division in a Department of Labor press release. "Daycare workers are among the lowest paid employees in the nation, and this employer profited by paying them below the federal minimum wage."

Employers can install a timeclock and use it in tandem with payroll processing systems to make sure workers receive the proper amount of wages on every paycheck.
