The U.S. Department of Labor (DOL) announced the Wage and Hour Division will be working in the Dallas and Fort Worth, Texas area as recovery efforts continue to repair damage caused by recent tornadoes. The division plans to actively participate in the community, offering businesses education about federal labor laws and encouraging employees to come forward if they are not receiving proper remuneration.
"Many industries involved in rebuilding, such as roofing and residential construction, employ large populations of low-wage and vulnerable workers who are less likely to step forward and complain when subjected to wage violations." said Cynthia Watson, regional administrator for the Wage and Hour Division in the Southwest.
Under the Fair Labor Standards Act (FLSA), all non-exempt employees are owed minimum wage and overtime pay for
time attendance leading up to a disaster and also tasks performed in the aftermath.
Watson adds the Wage and Hour Division is committed to ensuring employers are enforcing payroll policies that are in compliance with the FLSA throughout rebuilding efforts. This will ensure all contractors and subcontractors are playing on a level playing field as they compete for bids and not cutting costs by denying workers their rightful wages.
As employers engage in projects across the community, they might not know how to accurately track
employee attendance. Fortunately, they are now remote
timeclock systems that make it easy for workers to punch in when they arrive on a job site and clock out at the end of the day.
