In the latest employee lawsuit being brought against celebrity employers, Courtney Love is now being sued by former assistant Jessica Labrie. Labrie explains she was hired by the Hole frontwoman as an administrative assistant and forensic research aid.
She was paid $30 an hour, but did not receive overtime wages even though she was regularly required to work more than 60 hours a week. Under the Fair Labor Standards Act (FLSA), all nonexempt workers must receive at least minimum wage for all of their
time attendance and premium pay (one-and-a-half times their regular wage) for hours worked beyond 40.
The FLSA does include an exemption for administrative employees, if they are paid on a salary basis and earn at least $455 per week. They must also perform non-manual or office-related tasks and use their judgment and discretion on a regular basis.
Earlier this summer, Sharon Stone received notice that she was being sued for unpaid overtime and more recently, Celine Dion was the target of a similar charge.
These cases demonstrate the need of employers, both large and small to use a timekeeping system, such as a
timeclock, that will keep accurate records of employee work time. With these documents, they can be sure the allocate the proper pay or show investigators their payroll practices are upholding the FLSA.
