California security guard receives $425,000 for overtime

California security guard Ernesto Salamante was recently awarded $425,000 for unpaid overtime wages. Salamante filed a claim against his employer, a Los Angeles jewelry distributor, after eight years of employment.

Salamante was required to work 24 hours a day, seven days a week without receiving any overtime. The company even provided Salamante with a trailer on the premises for his living accommodations to get him to work longer than eight-hour shifts, without compensating him for the additional time attendance.

By California state labor laws, employers are required to pay workers one-and-a-half times the standard pay rate for any time worked past 40 hours in a single workweek. The lawsuit claims Salamante was unaware of his legal rights and the 73-year old was afraid he wouldn't be able to find another job. The business paid him minimum wage, but refused to cover overtime.

Salamante eventually reported his employer's payroll policies to the Division of Labor Standards and Enforcement. When the case was filed, Salmante's lawyers invoked more serious charges in connection with California's Elder Abuse Act on top of the employment laws, which increases the former employee's eventual settlement.
