California restaurant pays workers $316,000 for unpaid wages

To settle disputes with workers over unpaid wages, Pho Clement and Pho Clement 2 in San Francisco have been ordered Labor Commission. The decision settles eight cases brought against the California restaurants for unpaid minimum wage and overtime employee attendance.

Each of the eight employees that were filing charges will receive between $17,432 and $85,114 from the settlement, depending on the amount they were owed in unpaid wages.

"While we are grateful that this process has come to an amicable conclusion, refusal to pay workers for all hours worked has no place in California. Overtime laws are on the books for a reason and the state will protect both employees and the honest employers who play by the rules," said Labor Commissioner Julie Su.

While Fair Labor Standards Act (FLSA) laws only guarantee overtime pay for hours worked beyond 40 in a given workweek, the California state laws dictate that employers must pay employees overtime - one-and-a-half time the regular pay rate -  if they work more than 8 hours in a day or 40 hours in a week.
