Arby's employees to receive $57,000 in overtime back pay

More than 750 current and former employees of fast food restaurant chain Arby's are set to receive nearly $57,000 in back wages following an investigation by the U.S. Department of Labor, according to The Associated Press.

The department uncovered bonus miscalculations that affected managers at 255 of the restaurant's locations in five states - Arkansas, Illinois, Kansas, Missouri and Oklahoma. Specifically, the managers' overtime employee attendance hours were not included in the calculations - a violation of Fair Labor Standards Act provisions that require overtime to be factored into buses, incentive pay and commissions.

United States Beef Corporation - the largest Arby's franchisee in the world, according to its website - has agreed to compensate the workers. Each employee will receive approximately $75.

Last year, an FLSA time and attendance lawsuit garnered over $2.4 million for more than 2,200 current and former employees of McDonald's. The fast food giant failed to pay overtime to assistant manager trainees and misclassified them as exempt.
