The Mobile, Alabama firefighters' union will be suing the city over the enactment of a law banning the deduction of union dues from payroll, according to state news site al.com.
The Alabama Education Association had recent success in fighting the new law when a preliminary injuction that was filed by U.S. District Judge Lynwood Smith was recently upheld by the 11th U.S. Circuit Court of Appeals. Paul Cumbaa, president of the Mobile chapter of the firefighters' union, argued that the judge’s order was clearly meant to apply to all public employee groups whose dues are deducted from their paychecks. However, the mayor's attorney, Larry Wettermark, said the court's order was specific to the dispute between the teachers' union and the state.
According to Wettermark, the payroll deductions would only be allowed to continue if the union signed a certificate promising not to use the money for political activity. Similar proposals were also filed in Tennessee, Oklahoma, Mississippi and Florida, and more are expected to come.
Following the rejection of his plea, Cumbaa said his chapter had no choice but to join other union locals in suing the state and municipalities that are enforcing the law.
