34 Boston restaurants owe workers $1.3 million for overtime

A recent investigation by the Department of Labor's (DOL) Wage and Hour Division found that 34 restaurants are in violation of the Fair Labor Standards Act's (FLSA) minimum wage, recordkeeping and overtime provisions. Investigators said the Boston-area restaurants owed 478 workers back wages totaling $1,307,808.

This investigation is part of the DOL's ongoing effort to identify illegal payroll practices in the Massachusetts restaurant industry. Last year, the Wage and Hour Division assessed an additional $295,108 in penalties against restaurants in the state.

"The restaurant industry employs some of our country's lowest paid workers, who are vulnerable to exploitation," said secretary of labor Hilda L. Solis. "In response to the extensive level of noncompliance we discovered, we will expand our efforts to bring the industry into compliance to ensure that employees receive the minimum wage and overtime wages required by law."

The DOL found that the following restaurants were not properly paying employees for their time attendance: D'Ann's Restaurant in Abington, four Fresh City locations, three Metropolitan Club restaurant locations, the Metropolitan Club in Chestnut Hill, Miracle of Science Bar + Grill,  Middlesex Lounge, Tory Row, Audubon Circle and 15 Not Your Average Joe's locations across Greater Boston and eastern Massachusetts.
