The lawsuit first filed against the Back Bay Restaurant Group in fall 2010, is now making its way through the U.S. District Court in New Jersey, fueled by 300 employees who claim they were wrongly denied overtime pay and minimum wage.
Restaurateur Charles Sarkis founded the Back Bay Restaurant Group and until recently backed restaurants, including Charles Sarkis, Abe & Louie's, Joe's American Bar & Grill and the Atlantic Fish Co. Last year, most of the restaurants were sold to a private equity group.
Bijan Shakib brought the case against Back Bay Restaurant Group after he was required to work off-the-clock at one of their subsidiaries, Papa Razzi, in New Jersey, the Boston Globe reports. Shakib alleges managers at the restaurant regularly forces workers to fulfill job duties when they weren't being paid for
employee attendance. They also adjusted employees' time cards to avoid paying overtime wages, said Shakib.
Shakib reported the payroll violations to the New Jersey Department of Labor and Workforce Developments, as reported by the news source. The department conducted a one-time audit of the restaurant and found that management had, in fact, reduced the Shakib's hours worked by 61.15 hours over the course of a two-month period.
